Television Home shopping in France can be extremely lucrative, however the gateway to reaching the French consumer is tough and demanding. We call it the "terms and conditions from hell." It is a waste of a marketer's time to wade through all of the in-country rules and regulations, cultural dos and don'ts, etc. when penetrating the overseas markets. You could spend more than one lifetime trying to figure it all out and getting it right. This is why we work with overseas in- country marketers to sell your products as only they know how.

Fine Points of Individual Packing

Products must be packed in individual, plain, corrugated cartons which conform to mail order standards (French standards) to "ensure the merchandise is transported to the end consumer in a perfect state." The Home Shopping product code will be the ONLY identification on the carton.

The cardboard shall be double-walled and recyclable. The color shall be white for cosmetic products and brown for all others. Minimum dimensions allowing attachment of invoice envelope for address details shall be 26cm x 19cm. Further the special instructions to be written on carton will be: Fragile, Top/Bottom, Inflammable, Toxic, Corrosive depending on contents.

Where the supplier doesn't have the facilities to provide such packing, this will be provided by French Home Shopping and this expense will be invoiced to the supplier (you-the marketer) at cost. The supplier will provide instructions for the product in 4 languages (French, Dutch, German, and English).

Responsibilities for Delay and Financial Penalties
Your product must get to the French Home Shopping warehouses and processed on time! If there are any delays (48 hours) the company will provide express delivery to it's customers and bill you. Also, after 1 working day you will be charged a penalty of 10 Euros per article non-delivered on time. After 5 days they apply a further penalty which is more expensive and costly.

Product Quality and Expectations
You must supply the Home Shopping company with a valid CE, GS, and TUV Certification. If you don't know what these are, your overseas broker will provide all the information you need to ascertain what is appropriate for your requirements. The Company reserves the right to submit your products and instructions to French Legal Counsel, and all fees will be invoiced to you the marketer.

Your product could be dropped immediately if the law or standards governing such products change, or if there is an incident which would compromise your product. Naturally French Home Shopping is completely held harmless from any and all occurrences such as these.

Payment, Refunds, and Ongoing Orders
The price of any product is considered FOB at an approved French Home Shopping Warehouse. You are paid 90 days from receipt of invoice. The payment is for at least 80% of the total due, and the other 20% is held for refunds, returns, goods not purchased, or the consumer doesn't accept shipment. If any of the 20% withheld is left, that amount will be sent to you in 15 days-once notification is sent to you (the supplier).

Exclusivity and Right Timing
The marketer (you) will be required to grant a 6 months exclusivity from all shopping programs as of the date of signature of the contract. Should your products go into large French scale distribution you are required to grant a 20% discount which is passed onto the end-user French consumer. Finally, the law governing the contract with French Home Shopping is French Law, and all matters to resolve will be held in the Paris Courts.

Short of vacationing in Paris while your attend your hearing to resolve a dispute with the French Home Shopping Network-there are Huge dividends to be realized in the French market. However it is important to note the timing of WHEN to approach this home shopping network in your overall international sales venture.

There are twelve home shopping networks worldwide, and WHEN you go on French Home Shopping will be a CRUCIAL decision. The costs and sweat equity you have to invest will be a mutual decision to make with your international broker such as a Global Source Marketing, Inc.. Caveat Emptor!
